These Terms of Service (“Terms”) govern your use of our platform. By creating an account or using JerseyTradr, you agree to these Terms. If you don’t agree, don’t use the platform.
1. Who can use JerseyTradr
Browsing and collecting: You must be at least 13 years old to create an account, browse the marketplace, build your closet, and make offers. We do not knowingly collect data from children under 13 in compliance with the Children’s Online Privacy Protection Act (COPPA, 15 U.S.C. § 6501 et seq.).
Trading: To participate in a real trade (sending or receiving jerseys through our middleman service), you must be at least 18 years old. Under US law, contracts entered into by minors are voidable at the minor’s election (Restatement (Second) of Contracts § 14; applicable state minor-contract doctrine). To protect both parties, trading is restricted to adults (18+). If you are 13–17, a parent or legal guardian must accept a trade on your behalf and assumes full responsibility for all obligations arising from that trade, including shipping and fees.
Legal capacity: By accepting a trade, you represent that you are 18 or older and have the legal capacity to enter into binding contracts under the laws of your state.
We do not knowingly allow children under 13 to create accounts. If we discover an account belongs to someone under 13, we will delete it and any associated data promptly.
2. Accounts
You are responsible for keeping your account secure and for all activity that occurs under it. Use a strong password and don’t share credentials. Notify us immediately at dio@jerseytradr.com if you suspect unauthorized access.
Your handle (username) and profile are public. Don’t use a handle that impersonates someone else or is otherwise misleading.
3. How trading works
JerseyTradr is a peer-to-peer middleman service. We do not buy or sell jerseys. We facilitate trades between collectors and authenticate the items in transit.
The flow:
- You build an offer from jerseys in your closet. The other side accepts.
- Both parties ship their jerseys to us. No exceptions. Confirm your address and pay to get your inbound label; each side moves at their own pace, independent of the other. You pay your own round-trip shipping (your jersey to our facility, and your incoming jersey out to you once it clears authentication), calculated and shown in-app before you confirm.
- We authenticate every piece: stitching, tags, nameset, era-correct details, and condition against the listing.
- Jerseys that pass ship to their new owners the same day they clear. You receive photos and a verification report.
- The full process takes approximately 7–10 business days.
Void trades: A trade is void and items are returned if any jersey fails authentication, is materially different from its listing, or is a prohibited item. Return shipping is at the sender’s expense.
Fees: A flat $4.99 per side is charged when a trade is accepted. This fee is non-refundable once items are in transit. Fees never include shipping. Both traders have the same shipping obligation: each pays for two labels - sending their own jersey to our facility, and delivering the jersey they receive to their own address. Both are quoted at the live carrier rate and charged in-app before labels are issued.
Regular Trader (free): Your first trade is free (fee waived; shipping still yours).
Pro Trader plan: $12.99 per month for unlimited trades with no per-trade fee. The Pro Trader subscription covers the middleman service for physical trades and is processed via our payment processor; it is not a digital purchase subject to app store billing. Cancel anytime; access continues through the end of the billing period.
Current trade model: JerseyTradr currently supports jersey-for-jersey trades. Cash-on-top and direct jersey sales are not features of the current service. We may introduce additional ways to deal in the future; any new feature will be disclosed in updated Terms before it goes live (see §15).
4. Trading eligibility
JerseyTradr does not require identity or ID-document verification. Any signed-in account may list jerseys and, once trading is enabled, make and accept offers. We do not collect or store government-issued identity documents.
We may suspend, restrict, or remove any account that violates these Terms or engages in fraud or abuse (see Account termination).
5. Pricing and valuations
Current model: JerseyTradr does not assign prices, estimated values, or market indices to jerseys. Our service today is trade-based: a jersey is worth what someone will trade for it. We do not act as buyer, seller, broker, or appraiser of jerseys under the current model.
Future features: We may introduce optional paid features (such as buying, selling, or money-on-top trades) in a future version of the service. Any such feature will: (a) be announced before launch; (b) be described in updated Terms you must accept before using the feature; and (c) comply with applicable law at the time of launch, including any licensing or tax obligations that apply. We make no commitment to launch any such feature.
6. Prohibited items
The following may not be listed or traded on JerseyTradr:
- Counterfeit, replica, or unauthorized reproduction jerseys (see Counterfeit Policy)
- Items that infringe third-party intellectual property rights, including trademarks held by leagues, clubs, or licensors (Lanham Act, 15 U.S.C. § 1051 et seq.)
- Items that are stolen or whose provenance is reasonably in question
- Items prohibited by applicable federal or state law
- Non-jersey items (v1 scope restriction)
Listings of prohibited items will be removed. Accounts that list prohibited items may be suspended or permanently terminated.
7. Authentication service: liability posture
Our authentication process is a good-faith expert review by trained staff against publicly available authentication standards. It is not a warranty of authenticity, not an appraisal, and not insurance. We may miss defects that evade inspection. Our liability for any authentication error is limited to the fee paid for that trade.
We are not responsible for the condition of items damaged in shipping to or from our facility. Ship securely.
8. User content (listings, photos, bios)
By uploading photos, descriptions, or other content to JerseyTradr, you grant us a non-exclusive, worldwide, royalty-free license to display and store that content for the purpose of operating the platform. You retain ownership. You represent that you have the right to share the content and that it does not infringe any third-party rights.
We may remove content that violates these Terms or our Counterfeit Policy. You can report listings or users using the in-app report function.
9. Account termination
We may suspend or terminate your account for:
- Listing prohibited items (including counterfeits)
- Fraudulent activity or misrepresentation
- Repeated trade voids caused by inaccurate listings
- Harassment of other users
- Any material breach of these Terms
You may delete your account at any time from Settings. Deletion removes your personal data per our Privacy Policy, subject to retention obligations (trade records, consent logs).
10. Limitation of liability
To the extent permitted by applicable law, JerseyTradr and its operators are not liable for:
- Loss or damage to jerseys during shipping (outside our custody)
- Disputes between users unrelated to our authentication service
- Any indirect, incidental, or consequential damages arising from use of the platform
Our total liability for any claim arising from a trade is limited to the fees paid for that trade.
11. Governing law and dispute resolution
These Terms are governed by the laws of the State of [STATE], United States, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the platform shall first be submitted to good-faith informal negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in [STATE], in English.
12. Sales tax notice
JerseyTradr operates as a marketplace. Where US marketplace facilitator laws require it, applicable sales tax on platform fees is collected and remitted by us. Any tax that applies to your trade is shown before you confirm payment.
13. Service evolution
JerseyTradr is a growing platform. We reserve the right to introduce new features, service tiers, fee structures, and transaction types (including but not limited to direct jersey sales, money-on-top trades, and seller payouts), provided that:
- Any new fee or material new feature is disclosed to you in advance via email or in-app notice.
- Where a new feature requires your affirmative acceptance of updated Terms (or a separate agreement), you will be presented with those Terms and asked to accept them before you can use the feature.
- Continuing to use existing features of JerseyTradr does not constitute acceptance of Terms governing features you have not used.
Fees today: Platform fees are $4.99 per side per trade (first trade free) plus your own shipping at the carrier’s live rate, collected together at checkout; Pro Trader subscription at the price shown in-app. These are the only fees in the current version of the service.
14. Changes to these Terms
We’ll notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use after the effective date = acceptance.
